General terms and conditions

Article 1 – Definitions

In these terms and conditions the following terms shall have the following meanings:

- Consumer: the natural person who is not acting for purposes relating to his trade, business, craft or profession.

- Day: calendar day.

- Distance contract: a contract whereby use is made of a distance selling system organised by NeoKraft, up to and including the conclusion of the contract.

- Right of withdrawal: the option for the consumer to cancel the agreement within the statutory period of 14 days without giving any reason.

Article 3 – Applicability

These general terms and conditions apply to every offer from NeoKraft and to every distance contract concluded between NeoKraft and the consumer.

The text of these terms and conditions will be made available to the consumer before the agreement is concluded.

Article 4 – The offer

The offer contains a complete and accurate description of the products.

Obvious errors or mistakes in the offer do not bind NeoKraft.

Each offer is valid while stocks last or during the specified promotion period.

Article 5 – The Agreement

The agreement is concluded as soon as the consumer has fully completed the ordering process and has received an email confirmation from NeoKraft.

Article 6 – Right of withdrawal

The consumer can revoke the agreement within 14 days after receipt of the products without giving any reason.

To exercise the right of withdrawal, the consumer must inform NeoKraft by means of an unambiguous statement.

The consumer may use the model form in Appendix I for this purpose, but is not obliged to do so.

Article 7 – Costs in case of withdrawal

The costs for returning the products are borne by the consumer, unless NeoKraft indicates otherwise.

If the consumer cannot return a product in its original condition, a depreciation fee may be charged.

Article 8 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

- Products that are made to consumer specifications or are clearly personalized.

- Products that cannot be returned for hygienic reasons and whose seal has been broken.

Article 9 – The price

All prices in the webshop include VAT and exclude shipping costs, unless stated otherwise.

Any shipping costs will be clearly communicated during the ordering process.

Article 10 – Payment

The consumer can pay via the payment methods offered in the webshop.

NeoKraft does not charge additional fees for payment methods, which do not exceed the actual costs.

Article 11 – Delivery and execution

NeoKraft strives to deliver orders as quickly as possible.

Delivery times stated are indicative and may vary.

If delivery is delayed or a product is not available, the consumer will be informed in a timely manner.

Article 12 – Warranty and conformity

  1. Legal compliance
    NeoKraft guarantees that the delivered products comply with the agreement and meet normal consumer expectations. This statutory guarantee applies without prejudice to consumer rights under mandatory law.
  2. Factory warranty (3 years)
    In addition to the statutory warranty, NeoKraft provides a 3-year manufacturer's warranty on electrical appliances, unless otherwise stated. The warranty period begins on the date of delivery and applies exclusively to products intended for domestic use.
  3. What is covered under warranty?
    • Manufacturing and material defects that occur during normal household use.
    • Defects which are not the result of misuse or negligence.
  4. What is not covered by the warranty?
    • Normal wear and tear of parts such as carbon brushes, bearings, batteries, belts and accessories.
    • Damage due to improper use, improper installation, overloading or failure to follow the operating and safety instructions.
    • Damage due to external influences such as moisture, corrosion, dust, sand or extreme temperatures.
    • Defects caused by the use of non-original parts or accessories.
    • Damage caused by professional or industrial use when the product is not designed for this purpose.
  5. When does the warranty expire?
    • If the serial number or identification label is missing or has been altered.
    • If the product has been modified, opened or repaired by unauthorized parties.
    • If no valid proof of purchase can be provided.
  6. How to file a warranty claim?
    • Please report the defect via info@umi-europe.com, with a clear description of the problem.
    • Please include a copy of your proof of purchase and, if requested, photos of the product.
    • NeoKraft will determine whether the product needs to be returned for inspection.
    • If the complaint is justified, NeoKraft will repair or replace the product free of charge. If this isn't possible, we will offer an equivalent product or a refund.
  7. Transport for warranty claims
    The cost of returning the product is initially borne by the consumer. If the complaint is justified, NeoKraft will reimburse these costs.
  8. Non-transferable
    The warranty applies only to the original purchaser and is not transferable to third parties.

Article 13 – Liability

NeoKraft is not liable for damage caused by misuse or failure to follow instructions.

NeoKraft is not liable for indirect damages such as consequential damages or loss of profits.

Total liability is limited to the purchase price, except in cases of intent or gross negligence.

NeoKraft is not liable for force majeure such as natural disasters, strikes or disruptions.

Article 14 – Complaints procedure

Complaints can be submitted via info@umi-europe.com.

NeoKraft will respond within 14 days. If this is not possible, an estimated timeframe will be provided.

If a dispute cannot be resolved amicably, the consumer can use the ODR platform: https://ec.europa.eu/consumers/odr/.

Article 15 – Privacy and data protection

Your personal data will be processed in accordance with our privacy policy, available on our website.

Article 16 – Applicable law and competent court

Belgian law applies to these terms and conditions.

Disputes will be settled by the court of Antwerp, unless mandatory law provides otherwise.

Article 17 – Final provisions

NeoKraft reserves the right to change these terms and conditions.

If any provision is found to be void, the remaining provisions will remain in force.
